Legislative Update

Inclusion Legislation –
An Outline
It’s probably fair to say there has never been a more exciting time for the inclusion movement in Scotland. In all there are four new pieces of legislation now in force that make a real difference to the way children are included:
- Section 15 of the Standards in Scotland’s Schools Act 2000 (the presumption of mainstream) came into play in August 2003.
- The SEN and Disability Act, which outlaws discrimination against children with disabilities within the education system, is now in force.
- The Disability Strategies and Pupils’ Educational Records (Scotland) Act 2002, which obliges education authorities to develop accessibility strategies, came into effect in October 2002.
- The Education (Additional Support for Learning)(Scotland) Act became law on 14th November 2005
